The GCU apply regardless of the medium from which you access our Site (computer, smartphone, etc.).

We inform you that the present GCU may be modified at any time. These modifications are published online and are deemed to have been accepted without reservation by any visitor who accesses them after they have been put online. It is therefore your responsibility to read these GTUs carefully before browsing our Site.

By accessing and browsing our Site, you signify your acceptance of the GTCU.

Intellectual property

The Site is the exclusive property of VERODAV GROUP, the only company authorized to use and exploit the intellectual property rights attached to the “VERODAV GROUP” brand. These rights are protected by international and French law.

All trademarks (figurative or otherwise), illustrations, images and logos not owned by VERODAV GROUP remain the property of their respective owners, and their use by VERODAV GROUP on the Site has been authorized in advance.

Any total or partial reproduction, modification or use of these trademarks, illustrations, images and logos, for any reason and on any medium whatsoever, is strictly prohibited unless authorized by VERODAV GROUP and its applicable partners.

The same applies to any combination or conjunction with any other trademark, symbol, logotype or, more generally, any distinctive sign intended to form a composite logo. These provisions also apply to all copyrights, designs and patents reproduced on the Site.

The use of all or part of our Site, in particular by downloading, reproduction, transmission or representation for purposes other than personal and private use for non-commercial purposes is strictly forbidden.

Hyperlinks to our Site may only be created with our prior written consent. It may be revoked at any time. We accept no responsibility for the content of third-party sites linking to our Site.

Warning

VERODAV GROUP shall not be liable for any inaccuracies or errors, or for any loss or damage caused by or resulting from the use of information obtained from or through the Site. It is your responsibility to evaluate the information and other content available on or through the Site. The Site and the information and Products contained therein are subject to change at any time without notice.

You are informed that access to the Site may be interrupted at any time by VERODAV GROUP for reasons of maintenance, security or any other technical constraint.

You undertake not to hijack the Site’s security system, and not to install, in any way whatsoever, devices intended to restrict access to the Site or its content. You must not disrupt the proper operation of the Site, servers or networks linked to the Site, nor contravene any regulations, in particular those relating to the bypassing of the robot exclusion protocol.

No warranty

The Site and its content are provided “as is” and “as available”. VERODAV GROUP shall not be liable for and makes no warranties of any kind, express or implied, including any warranties relating to the absence of malicious programs (such as viruses, worms or Trojan horses), relating to the commercial value, or the suitability for use of the Site you are seeking. VERODAV GROUP does not warrant that the information contained on the Site is accurate, complete or up-to-date, that the Site is free of defects or that any defects whatsoever can be corrected, and assumes no liability in connection therewith.

By using the Site, you agree to do so at your own risk and assume full responsibility for any inability to use the Site, any loss of data and the costs associated with any assistance or repair of any hardware and/or software used by you to connect to the Site, and you agree to hold VERODAV GROUP harmless from any and all damages whatsoever that may be caused by or result from your use of the Site, or related to your use of the Site. If applicable law does not allow the exclusion of implied warranties, some or all of the above disclaimers may not apply to you.

Limitation of liability

VERODAV GROUP shall not, under any circumstances, be held liable for any damages whatsoever (including any actual, direct, indirect, special, punitive, loss of data, loss of profit, infringement of proprietary rights, or third-party claims). This limitation of liability applies whether in contract or tort, and even if VERODAV GROUP has been previously informed of the possible occurrence of such damages.

By accepting the TOS, you waive any and all claims against VERODAV GROUP for such damages. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so some or all of the above limitations may not apply to you.

You agree to defend, indemnify and hold VERODAV GROUP (including its representatives, employees, subsidiaries, agents…) harmless from any claim by a third party for damages resulting from your use of or access to the Site, your violation of these TOU, your violation of the law or the rights of third parties, including their intellectual property rights.

This Section 6 shall survive the termination of your use of the Site.

Applicable law – Languages – Disputes

The Site is created, controlled and operated by VERODAV GROUP from France. These GCU are governed by and subject to French law, without regard to conflict of laws rules. They are written in French. Should they be translated into one or more other languages, only the French text will be deemed authentic in the event of a dispute.

All disputes arising out of or in connection with these GCU shall be submitted to the French courts. Any action relating to the GCU shall be barred after one year.

VERODAV GROUP’s failure to exercise, on one or more occasions, the rights, options, claims or actions reserved to it by the GCU shall not be construed as a waiver of such rights, options, claims or actions.

If any provision of the GCU is found to be invalid by any applicable law or court decision, it shall be deemed unwritten, without invalidating or affecting the validity of the remaining provisions.
